PROMOTION TERMS & CONDITIONS

Please read these terms & conditions (“Terms”) carefully.  By entering the Promotion (as defined below), you are agreeing to be bound by these Terms.  You should also read our privacy policy at www.ccbsaco.comwhich explains how we will use the data you provide us with when entering this Promotion.

1. Subject to the provisions of paragraph 5 below, this promotion (“Promotion") is open to all persons over eighteen (18) years of age and who are permanently resident in or citizens of the Republic of South Africa (“RSA”) and in possession of a valid South African Identity Document.

2. This promotional competition (“Competition”) is run by Coca-Cola Beverages South Africa Pty (Ltd) (“Promoter”) and is open to all persons of 18 years or older and resident in South Africa, except the employees and their immediate families of the Promoter, the Promoter’s advertising and promotion agencies, associated companies, and outlet owners and staff.

3. The Promoter has engaged Strike Media (Pty) Ltd of Unit 205A, Building 20, The Waverly Business Park, Mowbray (“Strike Media”) to operate the Promotion.

4. The Promotion is being conducted at participating retailers within the RSA which are retailers of cans of Monster Energy product (each a “Retailer”) and promoted on the website at www.ccbsaco.com(“Website”).

5. No director, member, shareholder or employee or family member of a director, member, shareholder or employee of Coca-Cola Beverages South Africa and/or Monster Energy and/or Strike Media or their affiliated companies, subcontractors, agents or assigns, advertising agencies, advisers, dealers, suppliersor anyone else professionally connected with the Promotion is permitted to enter the Promotion (“Disqualified Person”).

6. By entering this Promotion pursuant to these Terms, each entrant (“you”, “your”, “entrant”) agrees to be bound by these Terms and by the decision(s) of Monster Energy, whose decision shall be final, in relation to all matters relating to the Promotion. No further correspondence will be entered into by Monster Energy.

7. All times and dates set out in these Terms refer to the times and dates in the RSA (UTC/GMT +2 hour).In the event of any dispute over the time or date of any entry submitted, the decision of Monster Energy shall be final.

8. The Promotion is only valid within the RSA and entrants must be within the RSA at the time of entering the Promotion, for the verification process and at the time of the prize being awarded should they be declared a Winner (defined below), failing which such person will be disqualified and the draw of a replacement entry shall take place under the same terms and conditions as the Draw (defined below).

Entry

9. The commencement date of the promotion is 00:00 on 01 February 2018 (“Commencement Date”) and the closing date for the promotion is 23:59 on 30 April 2018 (“Closing Date”). 

10. Entries will not be valid where SMS messages are received prior to the Commencement Date and after the Closing Date.

11. Entrants may enter by acting in accordance with these Terms and by purchasing any one (1) can of Monster Energy product from a Retailer (“Can”) and SMS messaging ‘MotoGP’ and the last four digits of the barcode found on of the Can to 45075.

12. Proof of purchase is required for entry into this Promotion, which includes a copy of the receipt gained at the point of purchase of the Can (“Till Receipt”).

13. The cost for the entrant to send a SMS message shall be one South African rand (R1.00). 

14. It is the responsibility of the entrant to ensure permission is gained from the individual who pays the mobile phone bill.

15. Entrants are limited to one (1) entry per person and each entrant shall not submit or attempt to submit more than one (1) entry.  Monster Energy reserves the right to refuse entry of any individual to the Promotion who submits or attempts to submit more than one (1) entry.

16. The number used by the entrant to enter the Promotion must be registered to the entrant.  

17. Any form of automated SMS message is invalid, including, without limitation, using devices or software to generate automated entries.  Monster Energy reserves the right to verify the validity of entries and to exclude entries it believes have been made using any automated entry techniques.

18. Valid entrants shall receive a bounce-back SMS message within twenty four (24) hours of the entrants’ entry as confirmation of the entrants’ entry into this Promotion.  Neither Coca-Cola Beverages South Africa, Monster Energy nor Strike Media are responsible for any delayed bounce back messages which are beyond their control for any reason.  The bounce-back message will be free of charge to the entrant.

19. All entries are deemed to have been received at the time of entry into Strike Media’s database, not at the time when the SMS message is sent from the entrant’s mobile phone.

20. No entrant shall be able to provide alternative contact information to that provided to enter the Promotion for any reason.

Prize & Requirements

21. Each entrant that validly submits their entry as set out in paragraph 11 above (each a “Valid Entrant”) will be entered into a prize draw, as operated by Strike Media andheld on or before 30 April 2018 (“Draw”) where the first three Valid Entries to be pulled from the Draw (each a “Winner”) shall each win a five (5) days trip for two (2) people from 13 June 2018 to 17 June 2018 to Catalunya, Spain (“Prize”) which shall consist of the following:

21.1.1.  two (2) general access passes for entrance and access to all public areas within the Moto GP™, Catalunya, Spain (“Event”) during the opening hours of the Event on each of 16 and 17 June 2018;

21.1.2.  four (4) night stay for two (2) people in twin room accommodation of no less than a three (3) star rating hotel to be selected by Monster Energy in its absolute discretion, subject to availability (“Hotel”);

21.1.3.  two (2) economy flight return tickets for two (2) people from an airport in the RSA to an airport in Catalunya, Spain (“Destination Airport”). The airport locations, dates and times of the flights shall be determined by Monster Energy in its complete discretion, subject to availability;

21.1.4.  return economy transfers from Destination Airport to Hotel and from Hotel to each day of the Event at the times, dates and mode of transport to be  determined by Monster Energy in its absolute discretion, subject to availability;

21.1.5.  selected meals as determined by Monster Energy in its absolute discretion throughout the dates of the Prize; and

21.1.6.  the opportunity to have a photographer take a photo of the Main Winner and the Elected Person (defined below) with the Monster Girls to create a poster.  The date, time and other details of the shoot shall be determined by Monster Energy in its complete discretion, subject to availability.  

22. Only the Winner and one (1) person, as chosen by the Winner, (“Elected Person”) may enjoy the benefits of the Prize. The Elected Person must be approved by Monster Energy, be over the age of eighteen (18) years and be resident in the RSA.

23. Before being declared a Winner and receiving the Prize, each potential winner will be required to submit to the following verification process:

23.1.  prove eligibility by, including, without limitation, present a copy of their Till Receipt, proof of age, residence and identity, which may include but is not limited to submitting a form of proof of residence, proof that they are the registered user of the phone,passport or similar government issued identification before receiving their Prize;

23.2.  copies of their passport and their travelling partner’s passport, within twenty-four (24) hours of being contacted by Strike Media. All passports for the possible winner and travelling partner must be valid for at least six (6) months from the stipulated dates of travel as determined by Monster Energy in their sole discretion. The Winner and Elected Person must be eligible for a visa to Spain, if applicable, and are required to disclose upfront any possible reason such an application may be rejected. Copies submitted must be emailed to Strike Media with the name, passport number, date of issue and expiry date clear on the copy. Blurred or obscured copies will result in disqualification. The Winner and Elected Person must also comply with any other travel requirements for entry into Spain, failing which the Winner will be deemed to have forfeited the Prize;

23.3.  Entrants, whose entries have been drawn and have been confirmed as valid after the verification process, will be notified telephonically within 24 hours from receipt of valid documentation set out in rule 23.2 and declared the Winner. The validity of such documentation is at Monster Energy’s discretion; and

23.4.  for the Winner and the Elected Person only, sign a waiver prepared by Monster Energy, in its complete discretion, specific to the Prize confirming understanding, compliance with and acceptance of the waiver.  Copies of the applicable confirmation and waiver can be obtained upon request to [INSERT].

Failure to provide Monster Energy with this information within the reasonable timeframe set by Monster Energy may result in the Winner forfeiting their Prize and Monster Energy drawing another qualifying entry as soon as reasonably possible thereafter.

24. The Prize is for the Winner and the Elected Person only. Monster Energy will not accept requests to increase the number of individuals.

25. Should the Winner be unable to use the Prize on the dates provided and determined by Monster Energy, the Winner will be deemed to have forfeited the Prize. In such event the Prize will revert back to Monster Energy

26. For the avoidance of doubt, all costs associated with the Main Prize, including without limitation, tax, valid health insurance for travel, travel visa (if applicable), transportation, sustenance, any entertainment and anything related to the Prize not specifically included and outlined in the definition of the Prize at paragraph 21 above will be borne solely by the Winner.  Accommodation is on a room only basis and the Winner and their Elected Person will be responsible for all food and beverage consumed and elsewhere and all additional room charges.The Winner hereby agrees to sign and comply with any terms and conditions provided by the relevant service providers for the services set out in paragraph 21.

27. It is the responsibility of the Winner to provide any required documentation and any other legal requirements for the Prize and/or documentation required by law and/or Monster Energy. In addition to any other the verification requirements set out in these Terms, Monster Energy may require the Winner to complete and submit an information disclosure agreement and indemnification, as well as supply a copy of their valid Identity Document within twenty-four (24) hours of being confirmed the Winner, to enable Monster Energy to ensure compliance with these Terms and the South African Consumer Protection Act 68 of 2008, as amended.

Notification and Prize Delivery

28. The Winner will be notified by email and/or telephone via the email address and/or telephone number provided at Valid Entry within seven (7) days of the Draw (“Notification”).     

29. Unsuccessful entrants will not be notified

30. The delivery details of the Prize shall be determined by Monster Energy in its complete discretion.  Details of delivery of the Prize (including but not limited to the time, date and location of delivery) shall be provided to the Winner of the Prize within [INSERT] days of the Notification.

31. No entrant shall be able to provide alternative contact information to that provided to enter the Promotion for any reason.

32. In the event that Monster Energy cannot contact a potential winner within twenty eight (28) days of Notification or a potential winner is unavailable to receive the Prize for any reason whatsoever, such entry will be deemed null and void and Strike Media shall draw another Valid Entrant as soon as reasonably possible thereafter.

General Terms

33. If there is any dispute as to the identity of a potential winner, the registered user of the number used to enter the Promotion shall be declared the Winner.  In such event, the decision of Monster Energy shall be final.

34. Sending a SMS message or any other form of evidence of sending a SMS message is not proof that your entry has been received.  Coca-Cola Beverages South Africa, Monster Energy and Strike Media accept no responsibility for entries that are incorrectly completed, lost, delayed or which are not received for any reason. 

35. The Prize is as described and is not transferable, not exchangeable and no cash alternative will be offered in the event that a potential winner is unable to claim any Prize for any reason whatsoever.  In the event of unforeseen circumstances, Monster Energy reserves the right to replace the entire Prize or Prize components with a prize of equal or greater value.

36. The Winner shall participate in reasonable publicity resulting from the Promotion if requested to do so by Monster Energy and/or Strike Media and the Winner consents to Coca-Cola Beverages South Africa, Monster Energy and/or Strike Media using their name, photograph and audio and/or visual recordings of them in any publicity relating to the Promotion.

37. Details of the Winner (including their name and town of residence) may be made available on the relevant pages of the Website.

38. To the fullest extent permissible by law, none of Coca-Cola Beverages South Africa, Monster Energy or Strike Media or any of their affiliate companies, employees, directors, employees, agents, assigns or sub-contractors accepts any responsibility or liability for any damage, loss, injury or disappointment suffered by any entrant entering the Promotion competition or as a result of accepting any Prize.  Proof of sending is not accepted as proof of receipt.  Coca-Cola Beverages South Africa, Monster Energy and/or Strike Media are not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the internet, telephone lines or at any website, or any delay or failure of any postal or equivalent delivery service, or any combination thereof, including any injury or damage to the entrant´s or any other person´s computer or mobile telephone related to or resulting from participation in the Promotion.  Nothing shall exclude Coca-Cola Beverages South Africa’s and/or Monster Energy’s and/or Strike Media’s liability for fraudulent misrepresentation, death or personal injury as a result of such entity’s negligence or any other liability that cannot be excluded or restricted by law.

39. All entrants and the Winner, as the case may be, indemnify Monster Energy, their advertising agencies, advisers, nominated agents, suppliers and/or associated companies against any and all claims of any nature whatsoever arising out of and/or from their participation in any way howsoever in this Promotion including, as a result of any act or omission, whether as a result of negligence, misrepresentation, misconduct or otherwise on the part of Monster Energy and/or use of the Prize.

40. Events may occur that render the Promotion itself or the awarding of any Prize impossible due to reasons beyond the control of Coca-Cola Beverages South Africa’s and/or Monster Energy’s and/or Strike Media’s and accordingly Coca-Cola Beverages South Africa’s and/or Monster Energy’s and/or Strike Media’s may, at its absolute discretion, vary or amend the Promotion and the entrant agrees that no liability shall attach to Monster Energy nor Strike Media as a result thereof.

41. Coca-Cola Beverages South Africa’s and/or Monster Energy’s and/or Strike Media’s reserve the right to:

41.1.  change the format of the Promotion and/or delay or postpone the Promotion or any stage(s), in whole or in part due to reasons beyond its reasonable control, without liability to the entrant; and

41.2.  refuse entry of any individual to the Promotion or future events organised by Monster Energy and/or Strike Media;

41.2.1.where Monster Energy and/or Strike Media reasonably believe that the Prize has been transferred to a third party in whole or in part;

41.2.2.where an entrant has been disqualified from any Coca-Cola Beverage South Africa and/or Monster Energy and/or Strike Media competition/ promotion or other prize draw within twelve (12) months of the Commencement date;

41.2.3.where Coca-Cola Beverage South Africa and/or Monster Energy and/or Strike Media reasonably believe such individual has not complied with these Terms;

41.2.4.where Coca-Cola Beverage South Africa and/or Monster Energy and/or Strike Media reasonably believe the entrant to be a Disqualified Person; or

41.2.5.where such individual is ineligible to participate in the Promotion (or if participation in the Promotion should have been refused for any reason whatsoever).

42. Save as expressly set out in these Terms, Coca-Cola Beverage South Africa and/or Monster Energy and/or Strike Media have no liability for any costs or expenses that may be incurred by any entrant. The Winner will be liable for any tax chargeable in relation to the Prize.

43. It is advised that all entrants retain a copy of these Terms for future reference. A copy of these Terms are available at no cost to the entrants and can be downloaded in printable form from www.ccbsaco.com.

44. The Promotion and these Terms are governed by the laws of the RSA and any disputes (contractual, non-contractual or delictual) arising as a result of, under or in connection with the Promotion or these Terms, are subject to the non-exclusive jurisdiction of the courts of the RSA.
