Terms and Conditions Governing participation in the Cappy® with Makro ‘Stand a chance to WIN 1 of 24 Nutribullet 600WATT Pro blenders’ Competition
The following Terms and Conditions apply exclusively to the aforementioned Competition and all Participants are deemed to have read, understood and accepted the same:
- This Promotional Competition (“Competition”) is organised by Coca-Cola Africa Proprietary Limited, Coca-Cola Beverages South Africa Proprietary Limited and Massmart Wholesale (Pty) Ltd (“Promoters”).
- The Competition is open to permanent residents of the Republic of South Africa above the age of 18 (eighteen) years, in possession of a valid form of identification (South African Identity Document or valid Passport with residency permit), except any minor, employee, director, member, partner, agent or consultant of the Promoters, or any person who directly or indirectly controls or is controlled by the Promoters and/or immediate family members of any of the above persons, its advertising agencies, advisers, dealers, suppliers and bottlers of beverages identified by the trademarks owned by or licensed to the Coca-Cola Company, its affiliates and/or associated companies. In addition, all participants must be natural persons; no prize/s will be awarded to any legal entities.
- By entering the Competition, all participants and the winner(s) agree to be bound by these rules/terms and conditions (“Official Rules”) as interpreted by the Promoters or their nominated administrator, whose decision regarding any dispute will be final and binding. The Promoters reserve the right at any time, without notice, to amend, modify, or change the Official Rules and any prizes, and to postpone, suspend or cancel this Competition and any prizes, or any aspect thereof, without notice at any time, for any reason which the Promoters reasonably deem necessary and without any compensation whatsoever.
- The Competition is only valid within the Republic of South Africa. Participants must be within the borders of the Republic of South Africa at the time of entering the Competition, for the verification process and at the time of the prize/s being awarded should they be declared a winner, failing which, such person will be automatically disqualified, and the draw of a replacement entry shall take place in the same manner as the first draw.
- The Competition commences on 14 March 2022 and ends at 23h59 South African time on 8 May 2022 (“Duration”). All entries received after the Duration will not be considered. Any entries received after the close of the Makro store’s operating hours 07h00 – 18h00 will be invalid and will not be considered. Online purchases made after 23h59 on the last day of the Competition will not be considered and are subject to government regulations. The Promoters reserve the right to extend the Duration of the Competition in the event that the Promoters have not received the minimum number of qualifying entries for the Competition Period
- Participants stand a chance to win 1 of 24 Nutribullet 600Watt Pro blenders valued at R2095.00 (two thousand and ninety-five rand), including VAT, each (“Prize”). The Promoters shall solely determine the specifications of the Prizes and the Promoters’ decision in this regard shall be final.
- The prize will only be awarded to a natural person as stipulated in these rules and will not be awarded to any legal entity. Where the winner is a permanent resident, a valid passport and residential permit must be presented in order to be awarded the prize. It may not be unlawful to supply the prize to a person in terms of any legislation or public regulation and the Promoter/s reserve the right to require proof that it will not be unlawful to supply a prize (for example to request the winner of a TV to provide his/her TV license to the Promoter/s before they can hand over the prize).
- Although the Promoter/s have taken care to make sure that the Prize is/are of a good quality, subject to Consumer Protection Act 68 of 2008, the Promoter does not give any warranties about the Prize and you agree to accept the Prize “as is”. Subject to applicable law, you also indemnify the Promoters against any damages that anyone may suffer as a result of the use of the Prize/s or participation in this Competition, including consequential and economic loss.
9. The Prize does not include any other costs or expenses relating to the Prize or the enjoyment of the Prize not expressly specified in these Rules. All taxes, insurances, and/or other expenses resulting from or relating to the Prize are the sole responsibility of the winner unless otherwise stated. From date of transfer of ownership any and all risk in the Prize will pass to the winner and it will be the winner’s sole responsibility to take out the necessary insurance in respect of the Prize. Accordingly, the Promoter’s and its affiliates, will not be responsible for any other expenses which the winner/s may incur as a result of their acceptance and/ or use of a Prize, whether foreseen or not. To the extent that any taxes, duties, levies or other charges may be levied on a prize by the government or any other competent government or regulatory body, the winner/s will be liable therefore, and the Promoter/s will not increase the value of the prize/s to compensate for such charges. The value of the prize includes VAT, and the prize will be given to the winner at the ruling price which is available to any customer on the day that the item is purchased from the participating store.
- To enter this Competition, Participants will be required to do the following:
- Purchase any two participating Cappy 1L or 1.5L PET variants as set out in paragraph below, from any MAKRO store nationwide; and
- Swipe their MAKRO card at the till and upon purchase.
- Participating Cappy 1.5L variants include:
o Apple Burst
o Breakfast Blend
o Mango Orange
o Orange Burst
o Orange Pulpy
o Tropical Punch
- Each purchase qualifies as 1 (one) entry into the Competition. Participants must retain till slip/s for proof of purchase.
- The Prizes are not transferable and may not be exchanged for cash. The Promoters reserve the right to substitute the Prize/s with any other prize/s of comparable commercial value or to vary, postpone, suspend, or cancel this Competition and the Prize/s (which has/have not yet been subject to selection), or any aspect thereof, without notice at any time and for any reason whatsoever.
- Participants may enter the Competition subject to the following:
- Automatic entry will occur on the Participant swiping their Makro card, and all entries must be made by a natural person manually by following the steps set out in paragraph 10 above.
- If any entry was made in a manner which in the Promoters’ discretion provides a participant with an unfair advantage over other entrants, such participant will be disqualified from this Competition.
- Participants may enter this Competition as many times as they like provided they complete the entry mechanics set out above each time. However, participants are only eligible to stand a chance to win 1 (one) Prize under this Competition.
- Entries that are submitted via an incorrect entry mechanism or contain errors or from disqualified person/s will be disqualified.
- Winners:
- 1 of 24 potential winners will be selected by the Promoter’s independent attorneys, KISCH IP, using a random draw tool on 10 May 2022 but not later than two weeks of the Competition Duration ending. To be verified as winners, the potential winners will be contacted by the Promoters (or the Promoters’ agents) by calling the number that each potential winner used to send a picture of their till slip in order to obtain proof of ID, full name, contact details and physical address to deliver the Prize. Those that do not comply with this validation process will be disqualified and replacement winners will be drawn until all the Prizes have been allocated.
- Once the Promoters have verified the winners, the Promoters will advise the winners when and how they will receive their Prize, via WhatsApp within two weeks of being notified as a winner. The winners will be randomly selected from eligible entrants for the relevant Competition Period on 10 May 2022 but not later than three (3) months after the closing date of the Competition.
- The Promoters’ decision shall be final and no correspondence will be entered into with a participant other than the winners.
- Once a winner has received a Prize subject to the CPA,, the Promoters will not take responsibility for any product malfunction or defect. Ownership of and risk in and benefit attached to the Prize will pass on to the winner immediately.
- The Prize winners are obligated to behave responsibly and comply with the Official Rules and all reasonable requests of the Promoters and their agents.
- Disqualification
- It is your responsibility to ensure that of all information provided by or on behalf of you to the Promoters is accurate, complete and up-to-date at all times.
If the Promoters (or their agents) are unable to reach a potential winner within 48 (forty eight) hours from the date that the Promoters (or their agents) contact potential winners for verification or if a potential winner fails the verification process after drawing the potential winner’s entry for whatsoever reason, such person will be disqualified and a draw for a replacement entry and winner will take place.
- Use of participant and winner information
- All participants and the winners, as the case may be, indemnify the Promoters, their advertising agencies, advisers, nominated agents, partners, suppliers and Bottlers of beverages identified by the trademarks owned by or licensed to the Promoters, their affiliates and/or associated companies against any and all claims of any nature whatsoever arising out of and/or from their participation in any way howsoever in this Competition (including, as a result of any act or omission, whether as a result of negligence, misrepresentation, misconduct or otherwise on the part of the Promoters and/or use of the prizes).
- Participants enter the Competition entirely at their own risk. To the extent permitted by law, the Promoters and their directors, affiliates, members, partners, employees, agents, consultants, suppliers, affiliates, associate companies, contractors, any participating store and/or its subsidiaries cannot be held responsible or liable for any accident, injury, harm or loss suffered by any person or entity as a direct or indirect result of entering the Competition or suffered as a direct or indirect result of the utilization in any way whatsoever of the prize won in terms of the Competition.
- Competition artwork is for illustrative purposes only. Participants hereby agree to release and indemnify the Promoter and its directors, affiliates, members, partners, employees, agents, consultants, suppliers, contractors and subsidiaries and hold it harmless against any and all losses, harm, damages, rights, claims and actions of any kind in connection with the Competition, promotion or special offer or resulting from the participation in the Competition or acceptance, possession, use or receiving of any prize relating to the Competition, including, without limitation, personal injuries, death and property damage, and claims based on publicity rights, defamation or invasion of privacy.
- The Promoter and its service providers, are not responsible for:
i. incorrect and inaccurate transcription of entry information;
ii. technical malfunction;
iii. inappropriate images and comments posted by the entry or by the public;
iv. lost or delayed data transmission, omission, interruption, deletion, line failure
or malfunction of any telephone network or computer equipment or software;
and/or
v. the inability to access any website or online services or any other error.
- This Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram or any other social media platform that may be used as an intermediary.
- The Promoters may require the winners to be identified, photographed and published in printed media, or to appear on radio and/or television, social media, when accepting their prizes or after having received their prizes. The winners will be given the opportunity to decline to the publication of their images and to participate in the Promoters’ marketing material in so far as it relates to the Competition.
- The Promoters and their affiliates (including subsidiaries, Bottlers, and joint ventures) may contact the participants via email and through social media platforms to deliver marketing communications regarding their products and promotional activities, subject to the provisions of the Protection of Personal Information Act, 2013. Personal information collected from the participants will be processed in accordance with what is described in the Privacy Policy accessible at www.coca-cola.co.za and that such use may include transfers to the Promoters’ affiliates and third-party service providers in any country.
- The Promoters may require the winners to complete and submit an information disclosure agreement and indemnification to enable the Promoters to ensure compliance with these terms and conditions and the Consumer Protection Act 68 of 2008. Should any winner refuse or be unable to comply with this clause for any reason, such a winner will be deemed to have rejected the prize and it shall revert back to the Promoters.
- By participating in the Competition, you consent to the sharing your personal information between the Promoter and its affiliates including holding and subsidiary companies.
- By posting any content, experiences, images on any social media platform, in relation to this Competition and its associated promotional activities, participants consent and give the Promoters a world-wide, royalty free and non-exclusive license, to reproduce, modify, adapt and publish any content posted and/or submitted by a participant on a social media platform, for the purposes of promoting the products and services of the Promoters.
- Unforeseen events
In the event of unforeseen circumstances or causes beyond the Promoters’ reasonable control, the Promoters reserve the right to cancel this Competition (before entries are received), to change the number or nature of the prize at any time (on 20 business days’ notice to you), or to change the rules at the Promoters’ discretion (provided that the Promoters will not change the conditions for participation or conditions for being awarded the prize, as stated herein).
